These Terms of Service (“Terms”) govern your use of the yourfitnessgym.co.uk website (the “Site”) and any purchase you make through it. By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms are governed by the law of England and Wales and are written to reflect UK consumer protection legislation, including the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Protection from Unfair Trading Regulations 2008, and UK GDPR / the Data Protection Act 2018.
1. Who We Are
“We”, “us” and “our” refers to Your Fitness Gym, trading from the address above. “You” refers to the person using the Site or placing an order.
2. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract to place an order on the Site. If you are under 18, you may only use the Site with the involvement of a parent or guardian.
3. Products and Descriptions
3.1 We make reasonable efforts to display product colours, dimensions and specifications accurately, but slight variations (e.g. due to screen display or manufacturing tolerances) may occur.
3.2 All products are subject to availability. If an item you order is out of stock, we will notify you and offer a refund, substitute, or the option to wait for restock.
3.3 We reserve the right to amend product descriptions, specifications and prices at any time before an order is accepted.
4. Orders and Contract Formation
4.1 Placing an order through the Site constitutes an offer to buy. A contract is only formed when we send you an order confirmation email; this confirms acceptance of your order.
4.2 We may refuse or cancel an order at our discretion (for example, in cases of pricing errors, suspected fraud, or stock unavailability), in which case any payment taken will be refunded in full.
4.3 It is your responsibility to check your order details (products, quantities, delivery address) before completing checkout.
5. Pricing and Payment
5.1 All prices are shown in pounds sterling (£) and, unless stated otherwise, are inclusive of UK VAT where applicable.
5.2 Delivery charges (if any) are shown separately at checkout before you confirm your order.
5.3 We accept payment via the methods shown at checkout (e.g. Visa, Mastercard, Maestro, American Express, Discover). Payment is taken at the point of order unless otherwise stated.
5.4 In the unlikely event a product is listed at an incorrect price due to a technical or human error, we reserve the right to cancel the order and refund you, even if the order has been confirmed.
6. Delivery
6.1 We aim to deliver within the timescales stated on the Site or at checkout. Delivery times are estimates and not guaranteed.
6.2 Risk in the goods passes to you upon delivery. Ownership passes once we have received payment in full.
6.3 If delivery is delayed due to circumstances outside our reasonable control, we will contact you as soon as possible and will not be liable for the delay, though you may cancel and receive a refund if the delay is substantial.
7. Your Right to Cancel (Cooling-Off Period)
7.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer buying online, you have the right to cancel your order within 14 days of receiving your goods, without giving a reason.
7.2 To cancel, you must inform us clearly (e.g. by email to Info@yourfitnessgym.co.uk) before the 14-day period expires.
7.3 You must then return the goods to us within 14 days of telling us you wish to cancel, in unused and, where reasonably possible, original condition/packaging. You are responsible for the cost of return postage unless the item is faulty or misdescribed.
7.4 We will refund you within 14 days of receiving the returned goods (or evidence you have sent them back), using the original payment method. We may make a deduction if the value of the goods has been reduced by unnecessary handling.
7.5 This cancellation right does not affect your separate statutory rights under the Consumer Rights Act 2015 (see Section 8), nor does it override any additional returns period we voluntarily offer (see our Refund & Return Policy, currently 30 days).
8. Faulty, Damaged or Misdescribed Goods
8.1 Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described.
8.2 If goods are faulty, not as described, or damaged on arrival:
- Within 30 days of delivery, you are entitled to a full refund or replacement.
- Within six months, you are normally entitled to a repair or replacement (and a refund if that fails).
- After six months, you may still have rights, though you may need to show the fault was present at delivery.
8.3 This is in addition to, and does not affect, any manufacturer’s warranty offered with a product.
8.4 To report a fault, contact us at Info@yourfitnessgym.co.uk with your order number and details/photos of the issue.
9. Use of the Website
9.1 You agree not to misuse the Site, including by: attempting unauthorised access, introducing malware, scraping content without permission, or using the Site for any unlawful purpose.
9.2 All content on the Site (text, images, logos, graphics) is owned by us or our licensors and protected by copyright and other intellectual property laws. You may not reproduce or reuse it without permission.
9.3 We may suspend or restrict access to the Site at any time, for maintenance, security, or other operational reasons.
10. Product Use and Safety
10.1 Fitness equipment purchased from us should be used in accordance with the manufacturer’s instructions and any safety guidance provided.
10.2 We are not liable for injury or damage arising from misuse, improper assembly, or failure to follow provided safety instructions.
10.3 Always consult a qualified professional before beginning a new exercise programme, particularly if you have any pre-existing health condition.
11. Liability
11.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.
11.2 Subject to clause 11.1, our liability for any loss arising from your use of the Site or a purchase is limited to the price paid for the relevant product(s).
11.3 We are not liable for indirect or consequential losses (such as loss of profit or business) that are not reasonably foreseeable to both parties at the time the contract was formed.
12. Privacy and Cookies
Your use of the Site is also governed by our Privacy Policy and Cookie settings, which explain how we collect, use and protect your personal data in accordance with UK GDPR and the Data Protection Act 2018.

15. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that if you are a consumer resident elsewhere in the UK, you may bring proceedings in your local courts.
